"It is the right of every human being to choose their gender."

Said the Supreme Court...

... in India.
It ordered the government to provide transgender people with quotas in jobs and education in line with other minorities, as well as key amenities....

"Recognition of transgenders as a third gender is not a social or medical issue but a human rights issue," Justice KS Radhakrishnan, who headed the two-judge Supreme Court bench, said in his ruling on Tuesday.

"Transgenders are also citizens of India" and they must be "provided equal opportunity to grow", the court said.

"The spirit of the Constitution is to provide equal opportunity to every citizen to grow and attain their potential, irrespective of caste, religion or gender."

The judges asked the government to treat them in line with other minorities officially categorised as "socially and economically backward", to enable them to get quotas in jobs and education.

I would like to see what clause of the Indian Constitution they are basing this "right" to choose gender on.

I was onboard with the court's decision until the word quotas showed up. People should be treated equally under the law - period. Affirmative action for whatever reason encourages tribalism and hatred between the favored group and the unfavored group. The favored group will constantly trash the unfavored group in order to prove that they still deserve the favored status while the unfavored group will hate the favored group for obvious reasons.

One of the biggest arguments from the homosexual community is that their sexual orientation isn't something that they choose, it's how they are born. Bt isn't your gender the opposite case? It's technically exactly the way the are born. I can see an argument from someone whose gender identity isn't clear form a biological point of view - maybe they are born with both sets of sexual organs. But someone born 100% genetically male who wants to be female is someone making a choice. I've never understood how that group squares up their argument with the gay'lesbian crowd to be one cohesive group.

This is India. India is run by quotas ("reservation").

For example:

Stick around, Sam L. I'm hard-pressed to imagine why it's a God-given right to choose your gender, but not your race.

Might be a good topic for a spoof movie, but real life is getting too wacky to spoof!

I thought gender was driven by your chromosomes -- specifically whether or not you have to "X" chromosomes (and thus are female) or one "X" and one "Y" (and thus are male). You can change your genitalia with an operation, but outside of science fiction and cartoons I'm not sure you can change your actual DNA. So how can it be a "right" to change something that cannot be changed?

Why are they denying the Science?

The third gender is a fairly variable thing across the Indian Subcontinent, with many forms and roles played.

To people who have never been exposed to that culture, it is unlikely to make any sense at all. As we see here.

Not surprised by the decision, though. The denigration of these people began under the British and things are moving back to the much longer historical period before that where this was accepted.

This is outrageous. Once more America is falling behind. I can't believe there are any rights in the Indian Constitution that aren't in America's. Our Justices just need to get off their lazy asses and find them--they're probably hiding in one of those penumbra things.

A lot of people who say they support transgenderism actulaly thik there is scientific evnidence that a transgendered person brain is like the opposite genders brain. They actually say this with a straight face as to the reason why transgendered people think they are the wrong sex.
No such evidence exists.
This gets even more complicated when we now introduce genders as social constructs where people can be both male and femail, or trigendered. How are those brains wired?
There is something called gender dysphoria, and that is a legitimate pscyhological condition where you think you're in the wrong body sexually. But no one can tell you the reason why people are suffering that.
Any other transgenderism is complete crap. The gender is a social construct arguement is bogus pop psychology and theater.
Not based on science. It's in fact based on gender stereotypes. And I thought we were supposed to move away from gender stereotypes.
In the interest of tolerance must we accept the most ridiculous arguments? Must we accept 20 genders as per Facebook when there are not 20 genders?

Those who are transgender say that SEX is determined by chromosomes but Gender is in fact a social construct.
Which is complete garbage. Define a woman as a social construct.

I think they are right (at least superficially; I haven't read all their reasoning.) Adults have the right to be what they wish at their own expense and as long as they don't trample on the rights of others.

Ironically, the caste system is still alive and well in India. Perhaps the lowest castes should get sex changes.
